Terms of Use

These Terms of Use (the “Terms”) set out the conditions for using the iOS app “UV neko” (the “App”), provided by melkito (the “Developer”). By downloading or using the App, you agree to these Terms.
1. What the App does
The App shows the ultraviolet index (UV index) for your current location and how it is expected to change over the hours ahead. The ultraviolet data comes from Apple Weather (WeatherKit).
2. Important notice about the UV index
- The UV index shown in the App is an estimate based on a weather forecast. It may differ from the actual amount of ultraviolet radiation.
- Cloud cover, altitude, reflection from the ground (snow, sand, water) and available shade can change how much ultraviolet radiation you actually receive at the same location.
- The App is not a medical device, and what it shows is not medical advice. Do not rely on the App alone when deciding about sunscreen, going outdoors, or anything concerning your skin or your health; consult a physician or another qualified professional where appropriate.
- If you have concerns about your skin or an existing condition, or if symptoms appear after sun exposure, seek medical attention promptly.
3. Pro (subscription)
Some features of the App are available through the auto-renewable subscription “UV neko Pro”.

The features provided with a subscription may change as the App is improved. If a feature that is currently provided is to be removed, we will give notice in the App beforehand.
Subscribing, payment and refunds are all handled by Apple. Please direct enquiries about those to Apple.
4. Use of location
The App uses your location in order to show the ultraviolet index where you are. For details on how it is handled, see the Privacy Policy. The App still launches if you do not grant location permission.
5. Prohibited conduct
When using the App, you must not:
- copy, modify, decompile, reverse engineer, redistribute or resell the App;
- place an excessive load on the App or on the servers it obtains data from;
- use or redistribute data obtained through the App in breach of the terms of the party that supplies it; or
- act in violation of law or public order.
6. Intellectual property
Rights in the App, its characters, screen design, icons and other assets belong to the Developer or to the respective rights holders. These Terms grant you a non-transferable, non-exclusive right to use the App on your own iOS device; they do not transfer any rights to you.
Weather data originates from Apple Weather. The Apple Weather marks shown in the App and on this site are displayed in accordance with Apple's attribution requirements.
7. Disclaimer
- The App is provided “as is”, without warranty of fitness for a particular purpose, of accuracy, or of uninterrupted operation.
- Part or all of the App may become unavailable if the provider of the weather data has an outage, changes its specifications, or ends the service.
- To the extent permitted by law, the Developer is not liable for damages arising from the use of, or the inability to use, the App. This does not apply where the Developer has acted intentionally or with gross negligence.
- Where any part of this section does not apply because of the Consumer Contract Act or another mandatory provision of law, that law governs to that extent.
8. Changes to and discontinuation of the service
The Developer may change the content of the App or stop providing it. If provision is to end, we will give notice in the App or on this site in advance where possible. If provision ends during a subscription period, Apple's rules govern how that is handled.
9. About Apple
These Terms are an agreement between you and the Developer. Apple is not a party to these Terms.
- The Developer, not Apple, is responsible for maintenance and support of the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
- The Developer, not Apple, is responsible for product liability claims, claims of failure to conform to legal requirements, and claims of third-party intellectual property infringement relating to the App.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
- You represent that you are not located in a country subject to a U.S. Government embargo and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Matters not covered by these Terms are governed by Apple's Licensed Application End User License Agreement.
10. Changes to these Terms
If these Terms change, this page will be updated and the “last updated” date revised. We will give notice in the App of any significant change. If you use the App after a change, you are deemed to have agreed to the revised Terms.
11. Governing law
These Terms are governed by the laws of Japan. If a question or dispute arises in relation to the App, the parties will first seek to resolve it through good-faith discussion.
